House Bill 837 was signed into law in March of 2023 in Florida. Under the new law, the statute of limitations to file a personal injury lawsuit in Florida has been reduced from four years to two years from the date of injury. It has also laid into place a modified comparative negligence system for compensation in personal injury claims. Under this new system, a plaintiff found to be more than 50% at fault for the injury is not eligible to recover damages. Furthermore, the law requires evidence provided in order to establish damages already paid for to reflect the amount actually paid, rather than the initial charge. Your personal injury lawyer can further discuss the law and how it may impact your personal injury case.
Yes, you can file a lawsuit for personal injury in Florida. A lawyer can assist you with this process along every step of the way. They will consult with you on your case, investigate and gather evidence surrounding the accident and your injuries, file the lawsuit, and represent you in negotiations with the defendant’s legal team or insurance company. If a favorable settlement cannot be reached during negotiations, they will be prepared to represent you in court. If you are considering suing for personal injury in the state of Florida, contact our team at Newman Injury Law today to schedule a consultation and determine the best steps forward for your case.
You absolutely should hire an attorney if you have been the victim of a car accident in Florida. A car accident can be particularly devastating and can lead to significant losses that carry with them a heavy financial burden. An attorney can help you file a claim or a lawsuit and seek financial compensation from the at-fault party that will help you offset these losses and begin your path to recovery. They will investigate your accident and gather evidence that proves negligence in the at-fault party, often the other driver, and enter into negotiations seeking to reach a settlement that represents the full and fair amount of compensation that you are owed.
Florida wrongful death claims are technically filed by the representative of the deceased’s estate. The settlement or jury award from these claims is added to the estate’s assets and distributed to the surviving heirs and beneficiaries.
The estate representative files the wrongful death suit on behalf of the surviving spouse, children, parents, or other close family of the deceased. Florida inheritance laws typically govern who is eligible for these suits. If you have lost someone close to you, contact Newman Injury Law to learn if you qualify for a wrongful death suit.
Commercial drivers must follow federal rules for maximum time on the road, hours traveled per week, and certain drug and alcohol prohibitions. Sometimes, both state and federal laws apply when a commercial truck driver causes an injurious crash. Failure to follow federal regulations could play a role in your Florida truck accident claim.
We carefully analyze each truck accident case to determine which state or federal regulations were flouted, then use fine points of law to illustrate how the driver violated these laws and caused the collision.
In Florida, most injured employees are covered by the state’s workers’ compensation laws. However, if a third party causes the injury, you may have grounds to file a suit against them in addition to collecting your worker's compensation benefits.
If your employer does not have workers’ compensation insurance coverage but should, then you almost certainly have grounds to file a lawsuit. You’re entitled to safe working conditions, with plenty of oversight to ensure that they are free of hazards or dangers. If your employer fails to provide this, then they may be found liable for any injury that subsequently occurs.
Our legal team reviews your workplace injury situation and advises you of your legal options for seeking benefits, filing a civil suit, or both.
